Texas 2A Mantique — Liability Waiver & Release Agreement

This Liability Waiver & Release Agreement (“Agreement”) is entered into between the customer (“Customer,” “you,” or “your”) and Texas 2A Mantique Gunstore (“Texas 2A Mantique,” “we,” “our,” or “us”). By purchasing, handling, or taking possession of any firearm, ammunition, or related product from Texas 2A Mantique, you acknowledge and agree to the terms below.

Assumption of Risk Firearms, ammunition, and related equipment are inherently dangerous. By purchasing, handling, transporting, storing, or using these products, you acknowledge that:

• You understand the risks of serious injury or death associated with firearms.
• You voluntarily assume all risks, whether known or unknown.
• You are solely responsible for the safe handling, storage, and use of any firearm or ammunition purchased from us.

Customer Responsibilities By signing or accepting this Agreement, you confirm that:

• You are legally eligible to purchase and possess firearms and ammunition under federal and Texas law.
• You have received, understand, and will follow all firearm safety rules.
• You will comply with all federal, state, and local laws regarding firearm ownership, transportation, and use.
• You will not use any product purchased from Texas 2A Mantique in a negligent, unlawful, or unsafe manner.

Release of Liability To the fullest extent permitted by law, you agree to release, waive, and discharge Texas 2A Mantique, its owners, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action arising from:

• Accidental or negligent discharge
• Improper handling or storage
• Misuse of firearms or ammunition
• Malfunctions or defects covered under manufacturer warranties
• Injuries, damages, or losses occurring during transport, use, or possession

This release applies even if the injury or damage is caused in part by the negligence of Texas 2A Mantique, except where prohibited by law.

No Warranty or GuaranteeTexas 2A Mantique:

• Makes no guarantees regarding your ability to legally possess a firearm
• Does not provide legal advice
• Does not warrant the performance, reliability, or safety of any firearm or accessory beyond the manufacturer’s warranty

Any defects, repairs, or warranty claims must be handled directly with the manufacturer.

Indemnification You agree to indemnify and hold harmless Texas 2A Mantique from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your misuse of a firearm or ammunition
• Your violation of any law
• Your failure to follow safety rules
• Any third‑party claims resulting from your actions

Training & Safety Acknowledgment You acknowledge that:

• Texas 2A Mantique recommends professional firearms training
• You are responsible for knowing how to safely operate any firearm you purchase
• You understand the importance of secure storage to prevent unauthorized access

Binding Effect This Agreement:

• Applies to all current and future purchases from Texas 2A Mantique
• Is binding upon your heirs, executors, administrators, and assigns
• Remains in effect unless revoked in writing by Texas 2A Mantique

Governing Law This Agreement is governed by the laws of the State of Texas. Any disputes shall be resolved in Lamar County, Texas.

Acknowledgment & AcceptanceBy signing this Agreement, or by completing a purchase from Texas 2A Mantique, you acknowledge that:

• You have read and understand this Liability Waiver
• You voluntarily agree to its terms
• You are legally competent to enter into this Agreement
